Who's eligible?

Individuals who received at least two telemarketing calls from or on behalf of Momentum Solar within any 365-day period during the class period. Current and former customers of Momentum Solar are not eligible.

Momentum Solar has agreed to a $30 million class action settlement to resolve allegations that it made illegal telemarketing calls in violation of the federal Telephone Consumer Protection Act (TCPA). Two class action lawsuits alleged that the company repeatedly called consumers without their consent, even when they were on the National Do Not Call Registry.

Plaintiffs argued that the unsolicited calls constituted a clear breach of TCPA regulations, which protect consumers from unwanted robocalls and telemarketing activity unless express consent has been given.

Momentum Solar denies the allegations but agreed to settle to avoid the burden and uncertainty of continued litigation.

Under the Terms of the Settlement

Eligible class members may receive cash compensation based on the number of calls they received from or on behalf of Momentum Solar. Compensation is available for up to 50 calls per individual, although the exact payment amount will depend on the number of valid claims submitted.

Rather than a lump-sum payout, Momentum Solar will fund the settlement in phases, starting with an initial $1 million payment within 90 days of final approval. Additional payments will be made over a 15-year period, totaling up to $30 million.

This long-term funding structure aims to ensure full settlement obligations are met, even as the company continues business operations.
